Old vs New Tax Regime for AY 2026-27: Which One Saves You More?

There is no single right answer, the better regime depends on your deductions. Here is how to think about the choice, who each regime suits, and one timing trap that can decide it for you.

Every filing season the same question comes up: old regime or new? The honest answer is that it depends entirely on how many deductions and exemptions you actually claim. For some people the old regime wins comfortably; for others the new regime's lower rates come out ahead. The only reliable way to know is to compute both.

How the two regimes differ

The old regime has higher tax rates but lets you claim a wide range of deductions and exemptions, 80C investments, HRA, home-loan interest, 80D health insurance and more. The new regime has lower rates and a higher basic exemption, but strips away most of those deductions. So the old regime rewards people who invest and claim heavily; the new regime rewards those who do not.

Who benefits from each

As a rough guide, the old regime tends to win when you have substantial deductions, a home loan, significant 80C investments, HRA on a real rent, and health insurance. The new regime tends to win when your deductions are small, you rent little or own outright, and you would rather not lock money into tax-saving instruments. The crossover point differs for everyone, which is exactly why a calculation beats a rule of thumb.

Switching between the regimes

Salaried individuals without business income can generally choose the regime each year at the time of filing. If you have business or professional income, the rules are stricter, opting back into the old regime requires filing Form 10-IEA within the due date, and you cannot flip freely year to year. This is another reason to decide deliberately rather than by default.

The late-filing trap

Here is the timing trap that catches people: if you miss your ITR due date and file a belated return, you can only file under the new regime, even if the old regime would have saved you more and even if you had filed Form 10-IEA. Filing on time is what preserves your choice. Miss the date and the choice is made for you.
